This session will examine the primary forms of dispute resolution, review the history of ADR, and discuss court mandated ADR and its legal frame work vs self-directed ADR.

Examine the primary forms of dispute resolution;   1) negotiation, 2) mediation, 3) arbitration and 4) litigation (trial).  Review the history of ADR, where/why it is needed and used the most.  Discuss court mandated ADR and its legal frame work vs self-directed ADR.  Examine the role and responsibilities of paralegals and legal assistants.  This may include 1) to find, select and evaluate the mediator / decision maker (criteria used).  2) prepare the client for the ADR process  3) addressing requests from the mediator / decision maker- what they need /ought to know,  i.e. key documents, case summary  4) to maintain confidentiality.
