The goals of marketing and IP are often at odds. Marketing desires a mark that is easily remembered by the consumer, but this type of mark is often weakly enforced. Examples will be given where the marketing department chose the “wrong” mark, resulting in litigation. Guidelines will be provided to help keep your marketing department out of court.
Scott H. Brown is the Associate General Counsel, IP of Weatherford. He received his B.S.-Mech./Ind. Engr. from SMU and his J.D. from The University of Tulsa. He has written numerous law journal articles on intellectual property, and is a guest lecturer at the University of Houston Law Center, and a speaker at various IP conferences around the USA.
